Orders:
Work will only commence on A Virtual Real Tour acceptance of full design specifications detailing all goods and services required. A Virtual Real Tour reserves the right not to accept an order at its discretion. Changes and additions to design specifications may be made prior to customer's acceptance of the goods and services ordered but A Virtual Real Tour reserves the right to charge the customer for any work undertaken until the time at which changed and/or new design specifications are provided to it.
Should the customer cancel an order after order acceptance by A Virtual Real Tour the customer will be charged for all work undertaken up until the time notice of cancellation is received by A Virtual Real Tour.
Delivery:
A Virtual Real Tour will make every effort to deliver goods and services ordered within the time frames specified in its order acceptance. A Virtual Real Tour commits to keeping its customers informed of any delivery delays arising from circumstances beyond it's control. In no event will A Virtual Real Tour be held responsible for losses incurred by the customer for delivery delays caused by circumstances outside it's control. A Virtual Real Tour will deliver the exact goods and services outlined on the order acceptance. Unless otherwise agreed, the customer is responsible for arranging access to the location at which the services are to be rendered.
A virtual tour is deemed delivered by A Virtual Real Tour when a CD-Rom containing all panoramic images, still photography imagery and (if required) associated web pages which constitute a complete virtual tour of all areas specified by the customer for the specified location photographed, have been physically received by the customer or by any party nominated to take delivery in the customer order and agreed to in A Virtual Real Tour’ order acceptance (the “receiving party”) OR if all files which constitute a virtual tour have been electronically received by “the receiving party”.
Still photographs are deemed delivered when all specified films, or proofs, or print enlargements, or digital images delivered by email, on CD-Rom or uploaded to the world wide web, have been physically received by “the receiving party”. If any deliverables are required to be mailed or couriered to “the receiving party” A Virtual Real Tour will charge the customer for all postage and handling fees incurred by it.
A web site is deemed delivered when all files and pages associated with the finished web site are uploaded to the assigned domain and directory with the designated web site host, to be chosen by the customer or recommended by A Virtual Real Tour.
A Virtual Real Tour takes no responsibility for the goods and services rendered once they have been delivered and accepted by the customer.
Acceptance:
The customer is deemed to have accepted the goods and services delivered two (2) working days after their delivery in accordance with the delivery definitions in the section headed 'Delivery' above.
Prices:
Prices quoted by A Virtual Real Tour are subject to change at any time. A Virtual Real Tour will endeavour to inform customers of changes to prices initially quoted and of any chargeable costs for work undertaken additional to those agreed to at the time of order acceptance.
Travel Costs:
If goods and services are required to be rendered outside the Sydney Metropolitan Area the customer will be charged for reasonable travel and accommodation expenses incurred by A Virtual Real Tour.
Invoicing:
An invoice will be issued on customer acceptance of the goods and services rendered or as specified in any non standard payment terms agreed to.
Payment Terms:
A 50% deposit of the total amount owing is required to be paid before work will commence. On completion of all work the remaining 50% of the total amount owing is to be paid. Full payment is due no later than 14 days after invoice date unless otherwise agreed.
Payment Method:
A Virtual Real Tour does not accept credit card payments. Payments may be made by cash and cheque.
Copyright:
All copyright of panoramic and associated imagery which constitute a virtual tour will reside with A Virtual Real Tour at all times. A Virtual Real Tour holds all rights to the idea, to the intellectual property, to the techniques employed to produce the virtual tour, and to any other technical information. A Virtual Real Tour reserves the right to seek compensation for any financial losses incurred due to any breach by the customer of the above stated rights. Unauthorised use or copying of A Virtual Real Tour' virtual reality tour technology and processes is not allowed under any circumstances. A Virtual Real Tour reserves the right to use any panoramic images produced by it for promotional reasons in the media, in printed publications, on the world wide web, or as links on its own web sites, without prior permission from the customer.
On customer acceptance of a virtual tour rendered by A Virtual Real Tour, the customer is granted a single use licence as follows:
The customer is licensed to use the virtual tour on, and only on, the customer’s own nominated web sites and is not permitted to distribute or share the product with anyone else. Copying, sharing and distributing the finished product on the world wide web or on CD-ROM or on any other medium is not permitted under any circumstances.
Additional copies or usage of a virtual tour beyond those specified in the order acceptance may be permitted subject to payment of additional agreed license fees to A Virtual Real Tour.
Due to the technique employed to produce virtual tours a small section of the panorama image (the ‘cap’) on the base of the panorama is without photographic content. A Virtual Real Tour normally fills that area with its logo for promotional reasons.
Subject to payment of an additional fee other customer specified logos or images may be incorporated in the ‘cap’.
All copyright for still photos remains with A Virtual Real Tour. The customer may use the finished images in any manner providing the intended use is not inappropriate, offensive or insulting to A Virtual Real Tour or any other persons.
All copyright of images, text and animations which constitute a finished web site will reside with the customer upon receipt of full payment. A Virtual Real Tour reserves the right to reference and link to the finished web site for any promotional reasons.
On all web sites that A Virtual Real Tour designs and builds A Virtual Real Tour reserves the right should it choose to, to place a text link on the bottom of each page of the web site stating ‘Site designed by A Virtual Real Tour’ which links to A Virtual Real Tour’ own web site.
